1. Introduction

These Terms of Service ("Terms") govern your use of the services provided by Beller Creatives ("BellerCreatives," "we," "us," or "our"), operated by Jerry Beller, accessible at bellercreatives.com. By placing an order or using any of our services, you agree to be bound by these Terms.

BellerCreatives is part of the AllScience ecosystem of products and services.

2. Services

BellerCreatives provides the following creative services for authors and content creators:

  • Book Cover Design -- Professional cover design including AI-generated artwork, typography, and layout. Delivered as print-ready and digital formats.
  • Audiobook Production -- Full audiobook production from manuscript to finished audio files, including voice selection, narration, and studio-grade mastering.
  • Writing Tools -- Grammar analysis, plagiarism detection, AI content detection, readability scoring, and export tools accessible through the BellerCreatives platform.
  • Bundle Packages -- Combinations of the above services offered at discounted rates.

3. AI Disclosure

BellerCreatives uses AI-powered tools in the production of its services. This includes custom-trained machine learning models for text generation, image generation, voice synthesis, and quality analysis. All AI-generated content is reviewed and refined through automated quality gates before delivery. By using our services, you acknowledge and consent to the use of AI tools in the production of your deliverables.

4. Orders and Payment

4.1 Pricing

All prices are listed in United States Dollars (USD). Current pricing at the time of publication:

  • Book Cover Design: $29.99
  • Audiobook Production: $49.99
  • Writing Tools: Included with platform access or as part of bundles

Prices are subject to change. The price displayed at the time you place your order is the price you will be charged.

4.2 Payment Processing

All payments are processed securely through Stripe. We do not store your credit card information on our servers. By making a purchase, you agree to Stripe's Terms of Service.

4.3 Order Confirmation

After placing an order, you will receive a confirmation email at the address you provided. This confirmation constitutes our acceptance of your order.

5. Delivery

  • Book Covers: Delivered within 24-48 hours of order confirmation and receipt of all required information (title, subtitle, author name, genre, and any design preferences).
  • Audiobooks: Delivered within 3-5 business days of order confirmation and receipt of your finalized manuscript.

Delivery timelines are estimates and may vary based on order volume and complexity. We will notify you if your order requires additional time.

6. Refund Policy

We want you to be satisfied with every order. Our refund policy varies by service type and production stage:

6.1 Satisfaction Guarantee

Every order includes one round of revisions at no additional cost. If you are not satisfied with your initial delivery, let us know within 7 days and we will revise the work based on your feedback. This revision round is included in all cover design and audiobook production orders.

6.2 Requesting a Refund

To request a refund, contact us at legal@bellercreatives.com with your order number and reason for the request. Refund requests are reviewed within 3 business days. Approved refunds are processed back to the original payment method via Stripe within 5-10 business days.

7. Intellectual Property

7.1 Your Content

You retain all rights to the content you provide to us (manuscripts, text, design briefs, etc.). By submitting content, you represent that you have the right to use it and grant us a limited license to use it solely for producing your order.

7.2 Deliverables

Upon full payment, you own the final deliverables produced for your order (cover designs, audiobook files, etc.). You may use them for any lawful commercial or personal purpose, including publishing on any platform.

7.3 Portfolio Rights

BellerCreatives retains the right to display completed work as portfolio samples for marketing and promotional purposes, including on our website, social media, and marketing materials. If you require confidentiality, please notify us before placing your order and we will accommodate your request.

7.4 Platform Tools

The writing tools, software, algorithms, and underlying technology of the BellerCreatives platform remain our intellectual property. Your access to these tools is licensed, not sold, and is subject to these Terms.

8. Acceptable Use

You agree not to use our services to:

  • Create, distribute, or promote content that is unlawful, defamatory, or infringes on the rights of others
  • Submit content that you do not have the right to use
  • Attempt to reverse-engineer, decompile, or extract the underlying models or technology of our platform
  • Resell or redistribute our tools or services without authorization
  • Overload or interfere with the operation of our platform

9. Limitation of Liability

To the maximum extent permitted by applicable law, BellerCreatives and its owner, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of our services.

Our total liability for any claim arising from these Terms or our services shall not exceed the amount you paid for the specific service giving rise to the claim.

We do not guarantee that our services will be uninterrupted, error-free, or that deliverables will meet every subjective expectation. We do guarantee that all work meets our published quality standards (9.0/10 minimum score across automated quality gates).

10. Indemnification

You agree to indemnify and hold harmless BellerCreatives, its owner, and affiliates from any claims, damages, losses, or expenses (including reasonable attorney fees) arising from your use of our services, your content, or your violation of these Terms.

11. Dispute Resolution

Any disputes arising from these Terms or your use of our services shall first be addressed through good-faith negotiation. Contact us at legal@bellercreatives.com to initiate a resolution.

If a dispute cannot be resolved through negotiation within 30 days, either party may pursue binding arbitration administered under the rules of the American Arbitration Association. The arbitration shall take place in the United States, and the language of arbitration shall be English.

You agree to resolve disputes on an individual basis and waive any right to participate in a class action lawsuit or class-wide arbitration.

12. Termination

We reserve the right to suspend or terminate your access to our services at any time if you violate these Terms. Upon termination, any pending orders may be cancelled and refunded at our discretion.

You may discontinue using our services at any time. Obligations that have accrued prior to termination (including payment obligations and intellectual property rights) shall survive.

13. Modifications to Terms

We may update these Terms from time to time. When we make material changes, we will update the "Effective Date" at the top of this page and, where practical, notify existing customers by email. Your continued use of our services after changes are posted constitutes your acceptance of the updated Terms.

14. Governing Law

These Terms are governed by and construed in accordance with the laws of the United States. Any legal action related to these Terms shall be brought in a court of competent jurisdiction.

15. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
